TERMS OF SERVICE

From now on and because of both sides safety with any orders, I will only take commissions on VGEN. VGen is a platform where you can sell and purchase commissions, payments are made via PayPal, credit/debit cards from VISA, MASTERCARD, AMEX AND DISCOVER, apple pay and google pay. As of 09 Jan 2025 I only can accept PayPal payments.
Only exceptions are made to national orders where the payment is made on my national currency: MXN. Please refer to the next terms on part 1. About payments.Before commissioning me, please, carefully read my terms of service to get all the necessary and important information. It’s important to read them as you’ll automatically be accepting my terms when ordering. I will not be held responsible for your own misconception if you did not read the terms of service. Once I accepted your request I'll assume you have read and accepted all of these conditions. Ignoring these conditions will end of blacklisting you from commissioning or requesting any illustration from me again.I DO NOT SUPPORT AI ART/NFT/CRYPTO, DO NOT USE MY ART FOR SUCH THINGS. DO NOT FEED IA MAKERS/PROGRAMS WITH MY ART

1. About payments.
1.1 All payments must be done before starting the work or after the sketch approval. I wont accept half payments or payments when the illustration is done, as well, I won't continue or start working until the payment is done.
1.2 EURO/USD payments will be received ONLY through PayPal. / Los pagos en MXN sólo serán aceptados por medio de depósito por OXXO o transferencia bancaria.
1.3 Once I received payment there will be NO REFUNDS, unless I find it necessary (check "About refunds" for more information)
1.4 I wont be accepting another payment method or mixed payment methods unless I specified that I'll accept it. For example: mixed payments with DA points + EURO via PayPal or payments with AC's.
1.5 When payments are sent through paypal, there's the option of convertion between USD/EURO and MXN, YOU MUST SEND THE PAYMENT IN EURO, NOT MXN.
1.6 I will request payment to your Paypal address through an invoice. This is to avoid accidental transactions.
2. About corrections and changes.
2.1 As the client, you have the right to correct the drawing when I do something wrong, i.e: when I put a wrong color or miss a detail. Nevertheless, once you approve the sketch you will have 5 limited changes or corrections for the illustration. Sketch phase corrections are completely free.
2.2 Once you get 5 changes after the sketch approval, it will add 1.5usd for every correction you want for the illustration. Consider that once I get to the lineart or base colors it's more difficult for me to make any changes without messing the drawing or simply there are some things that I can't change in that phase, as the pose or the character, but there are other simple things I could change, as the expression or a color in the illustration.
2.3 You are NOT allowed to change details on the final illustration without y permmission (except for background color). Any edit on my illustrations that are not made by me are forbidden.
3. About refunds
3.1 As I said before, once I received payment there will be NO REFUNDS. You cannot request a refund from PayPal unless I stated that I will accept the refund, wich will only occur if something serious happens.
3.2 Refunds can happen if I can't finish the drawing or if the client gives me reasons to cancel the commission. If the client wants to continue with the work when I'm available again to work, it will be done according to the client and me.
3.3 percentage of refund will depend on how much I had advanced the commission. I won't give full refunds under any reason.
3.4 You can't request a refund if I already finished my work or just because you didn't like the drawing or wont use it anymore. Please don't force that, I will blacklist you if you refund the money from paypal without warning.
3.5 By purchasing any of my services you're automatically accepting my Terms of Service and being obligated to follow them. As well as promising you won't request any Paypal chargeback.
4. About TAT or Turnaround time.
4.1 I usually take 1 month to finish a single work after the sketch is approved. I tend to work fast sometimes, other times I'm pretty slow with work. Consider that my TAT applies per work, this means that, if I have a long working queue the TAT will be longer. General TAT is 1 month.
4.2 My TAT depends on the type of work I'm requested to do. For example, for an sketch it usually would take me an hour, without taking in count any other basic activity in the day, but a full illustration would take me between 3 to 10 hours. I have break times, I sleep, I study and I literally manage all my work, studies and daily life at the same time only by myself. This is why I take my time doing commission works, always trying to keep contact with the client as I can. Please, don't rush me, unless I stated or accorded with you an specific TAT and I'm late or I don't reply to your messages, but also keep in mind that I still have a life outside!
4.3 If you need your commission to be finished by a certain date (for example; the commission is a birthday present for someone) you must state it in the form. Extra fees may be charged due to giving your commission priority.
4.5 I do not work with commissions on weekends (Saturday and Sunday), nevertheless, you can still message to ask for a commission on these days!
4.6 TAT applies once the sketch is approved. Time during the sketch phase is usually 1-3 days if there's no corrections. I usually (not always) have the sketch done on the first day. However, if there's queue, then it can be longer. Please check my trello page for queue info!
5. About privacity, copyright and commercial use.
5.1 You're, under any circumstances, able to use my work for commercial use, i.e. merch, reselling the drawing, or use it on twitch, YouTube, Patreon or any media WITH PROFIT, unless is stated at the star that the commission will need commercial use permission.
5.2 Prices for commercial commissions will vary, depends on the use of it and the profit you may obtain. If you want information, please send a DM to any of my social medias! I'm usually very active on toyhouse and I constantly check twitter.
5.3 Commissioned pieces use is only for the commissioner. You can use it for banners, graphics, personal prints, desktop wallpapers etc, but you cannot use it for any profit. This means my art should not appear on any product that is or will be sold.
5.4 As the artist, I hold every right to the produced artwork, so I may use the picture anywhere in order to promote myself. Unless stated otherwise prior to the commission.
5.5 You're NOT ALLOWED to change, modify, or use my works for purposes that weren't discussed at the start; take credit for the art nor remove my watermarks/signatures or use any of my creations in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
5.6 If you wish for the artwork to not be uploaded anywhere on the internet I'll charge you an extra fee of the total price. As the artist, I will not upload the artwork to any media, but you'll also will be not allowed to. (can be discussed tho)
6. What can I order and what I will receive?
6.1 When ordering from me, take in count that you will only receive a digital artwork, there won't be any physical product as stickers, figures, prints, etc. Just the digital file, which will be sent via email, sta.sh or toyhouse.
6.2 Don't ask me to draw in another style. If you're ordering an artwork from me, it means you already know my style. I may be able to draw in a different style, but I don't really feel comfortable copying anyone elses art style for comms.
6.3 Please refrain from requesting anything that is listed as "don't". And please keep in mind anything extra will have a fee. If you're in doubt of anything I'm willing to draw or not please ask me before filling out a form.THIS IS A DIGITAL SERVICE. YOU'LL ONLY GET DIGITAL FILES.
